The general principle Allocation

The devolution of authoritative the bodies takes place by division (in the founding treaties are the key areas where bodies may operate on an exclusive basis and without interference of the states (so-called exclusive competence) or areas where the competence of bodies competing with one Member (cd Subjects of competence). → These lists should be considered mandatory (ie the principle of mandatory nature of the assignments) so as to determine with certainty the scope of devolved powers to the EU (so-called principle of attribution). (art. 5 § 1 Trat. EU)
Tal text of the EU Treaty can be seen the following scenario institutional
• The 3 basic functions to cui si rivolge l’azione dell’Unione europea → attribuzioni comunitarie esercitate in via esclusiva dagli organi comunitari:
- assicurare il corretto funzionamento del mercato comune e in particolare dell’Unione economica e monetaria (UEM) esecutiva dal 1992 e rafforzata con l’introduzione dell’euro dal 1999;
• There are policy areas reserved to the competence of bodies (agriculture, transport, network, transactional, commercial policy, monetary policy, trade cooperation with countries overseas.
• Most of the subjects devolved to the EU are only partially within the functions of bodies such matters as the competence of the Union concurs with that of the States. (matters of shared competence: economic policy, consumer protection, energy, tourism, employment, immigration, civil protection, health, development ...) • There are a
