The general principle of subsidiarity

Introduced by the Treaty of Maastricht. With this principle the EU can act to regulate matters that fall within its exclusive competence (competence competitor) in cases where action by Member States do not appear adequate to achieve the goals set by the EU Treaty. It provides Member States a sort of white rule likely to justify the actions of EU legislation in all matters competitor. Be the sole Community intervention every time a successful outcome for the community objectives can be achieved also through regulatory intervention of the member states.
